NOIREPLUME TERMS AND CONDITIONS

TABLE OF CONTENTS

1. GENERAL PROVISIONS

  1. These Terms set out the rules for using the website available at https://noireplume.com/ (hereinafter: the “Service”).
  2. The owner and administrator of the Service is:
    • Noireplume
    • E-mail: contact@noireplume.com
  3. The Terms define the rights and obligations of users and of the administrator of the Service.
  4. Use of the Service is voluntary and constitutes acceptance of these Terms.
  5. The Service allows users to publish their own text content and to use the functionalities made available by the administrator.
  6. These Terms constitute the terms of providing services by electronic means within the meaning of Article 8 of the Polish Act of 18 July 2002 on the provision of services by electronic means.
  7. The Service may be used by persons who are at least 16 years old. Persons under 18 years of age may use the Service with the consent of a parent or legal guardian, to the extent required by applicable law, in particular with regard to the processing of personal data on the basis of consent.
  8. The agreement for the provision of services by electronic means is concluded upon the creation of an account and remains in force until the account is deleted by the user or the administrator in accordance with the Terms.

2. DEFINITIONS

For the purposes of the Terms, the following definitions apply:

  1. Administrator – the owner of the Service.
  2. User – any person using the Service.
  3. Content – any materials published by users, in particular texts, comments, and other information made available through the Service.
  4. Account – an individual user profile created upon registration.

3. REGISTRATION AND USER ACCOUNT

  1. Using selected functionalities of the Service may require creating an account.
  2. The user undertakes to provide true and up-to-date data during registration.
  3. The user is responsible for keeping their login credentials confidential.
  4. Sharing the account with third parties is prohibited.
  5. The administrator may block or delete a user’s account in the event of:
    • a breach of the Terms,
    • publishing content that is unlawful,
    • using the Service in a manner that threatens its security or stability,
    • taking actions that infringe the rights of other users.
  6. The user may stop using the Service at any time and request the deletion of their account.

4. COPYRIGHT AND LICENSE

  1. The user declares that they hold the rights to the published content or are otherwise authorized to make it available.
  2. The user retains all copyright to the published materials.
  3. Upon publication, the user grants the administrator a free-of-charge, non-exclusive, territorially unlimited license to:
    • store and host the content,
    • reproduce it to the extent necessary for the operation of the Service,
    • make the content publicly available through the Service,
    • create backup copies,
    • technically process the content in order to properly provide the services.
  4. The license remains in force for the period during which the content is published in the Service and for the time necessary to maintain backup copies.
  5. Deletion of the content by the user ends the use of the license, except for backup copies stored for a period resulting from justified technical needs or legal obligations.

5. RULES FOR PUBLISHING CONTENT

  1. The user bears full responsibility for the content they publish.
  2. Published content must comply with applicable law and good practice.
  3. It is prohibited to publish content that is:
    • unlawful,
    • infringing copyright or intellectual property rights,
    • infringing the personal rights of third parties,
    • containing hate speech, threats, or offensive content,
    • promoting violence, discrimination, or unlawful activity,
    • containing spam or unsolicited advertising content,
    • containing viruses, malware, or other elements that may disrupt the operation of the Service.
  4. The administrator has the right to remove content that violates the Terms or applicable law, and to block the account of a user committing such violations.

6. REPORTING VIOLATIONS

  1. Any user may report to the administrator content that violates the Terms or applicable law.
  2. Reports should be sent to the e-mail address: contact@noireplume.com.
  3. The administrator reviews reports within a reasonable time and may take action consisting of removing the content, restricting access to it, or blocking the user’s account.

7. USE OF THE SERVICE

  1. Use of the Service is free of charge.
  2. The user undertakes to use the Service in accordance with its intended purpose.
  3. It is prohibited to:
    • attempt to gain unauthorized access to the Service,
    • disrupt its operation,
    • use automated tools for the mass publication of content without the administrator’s consent,
    • take actions that may compromise the security of the Service.

8. ADMINISTRATOR’S LIABILITY

  1. The administrator exercises due diligence to ensure the proper functioning of the Service.
  2. The administrator does not guarantee uninterrupted availability of the Service or the absence of technical errors.
  3. The administrator is not liable for:
    • content published by users,
    • damage resulting from the use of content published by users,
    • interruptions in the operation of the Service resulting from failures, technical work, or force majeure,
    • loss of data caused by circumstances beyond its control.
  4. Responsibility for published content lies solely with the user.
  5. These provisions do not exclude the administrator’s liability towards consumers to the extent that excluding such liability is not permitted under applicable law.

9. PERSONAL DATA AND PRIVACY POLICY

  1. The controller of users’ personal data is the Administrator of the Service indicated in 1(2) of the Terms.
  2. Users’ personal data is processed in accordance with applicable law, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR) and the Polish Act of 10 May 2018 on the Protection of Personal Data.
  3. Personal data is processed only to the extent necessary to:
    • create and maintain the user account,
    • provide services by electronic means through the Service,
    • ensure the security of the Service,
    • handle reports and complaints,
    • fulfill obligations arising from the law.
  4. Detailed information regarding the rules of personal data processing, retention periods, legal bases for processing, data recipients, and the rights available to users is set out in the Privacy Policy available in the Service.
  5. Use of the Service may involve the use of cookies and similar technologies. The rules of their use are described in the Privacy Policy or Cookies Policy made available in the Service.
  6. Every user has the right to access their personal data, rectify it, delete it, restrict its processing, transfer the data, object to processing, and the right to lodge a complaint with the President of the Personal Data Protection Office if they consider that the processing of their data violates applicable law.

10. COMPLAINTS

  1. The user may submit complaints regarding the operation of the Service to the e-mail address: contact@noireplume.com
  2. A complaint should include a description of the problem and data enabling contact with the user.
  3. The administrator will review the complaint without undue delay, no later than within 14 days of its receipt.

11. CONTENT MODERATION AND REPORTING PROCEDURES (DIGITAL SERVICES ACT – DSA)

1. Electronic Points of Contact

  1. An electronic point of contact for users of the Service is designated at the e-mail address: contact@noireplume.com.
  2. An electronic point of contact intended for direct communication with the authorities of the Member States, the European Commission, and the European Board for Digital Services is designated at the e-mail address: contact@noireplume.com. Communication may be conducted in Polish and English.

2. Mechanism for Reporting Illegal Content (Notice and Action)

  1. Any person or entity may report to the Administrator the presence in the Service of information that they consider to be illegal content or content that violates these Terms, by e-mail to: contact@noireplume.com.
  2. A report should include:
    • a sufficiently substantiated explanation of the reasons why the information is considered illegal;
    • a clear indication of the exact electronic location of the information (in particular the exact URL or URLs);
    • the name or business name and the e-mail address of the person or entity making the report (except for reports concerning information related to child sexual abuse offenses);
    • a statement confirming the good faith and accuracy of the reported information.
  3. The Administrator promptly confirms receipt of the report to the reporting party at the provided e-mail address and, without undue delay, informs them of the decision taken.

3. Content Moderation and Imposition of Restrictions

  1. The Administrator carries out content moderation in order to ensure the safety and lawfulness of the Service’s operation. Moderation is based on verification carried out by humans (moderators) and, additionally, on automated filtering tools or anti-spam algorithms.
  2. If illegal content or content violating the Terms is detected, the Administrator may decide to:
    • remove the content, disable access to it, or demote it;
    • fully or temporarily suspend the provision of services to the user (block or delete the account);
    • suspend the user’s ability to monetize content [if applicable].

4. Statement of Reasons

  1. If the Administrator imposes any of the restrictions referred to in section 3, it promptly provides the User affected by the decision with a clear and specific statement of reasons for the decision at their e-mail address.
  2. The statement of reasons includes an indication of the facts, the legal or contractual basis, information on the use of automated means in making the decision (if this was the case), and information on the available means of redress.

5. Internal Complaint-Handling System (Appeal Procedure)

  1. A User in respect of whom a decision to remove content or block an account has been taken, as well as a reporting party whose report has been rejected, has the right to lodge a free-of-charge complaint under the internal complaint-handling system.
  2. A complaint may be lodged within 6 months of being informed of the Administrator’s decision, at the e-mail address: contact@noireplume.com.
  3. The complaint will be examined under the supervision of qualified personnel (a human), in an objective manner and with due diligence, within 14 days of its receipt.

6. Measures Against Misuse

  1. The Administrator has the right to suspend, for a reasonable period and after prior warning, the provision of services to a User who frequently publishes manifestly illegal content.
  2. The Administrator has the right to suspend, for a reasonable period and after prior warning, the processing of reports and complaints submitted by persons or entities that regularly submit manifestly unfounded reports or complaints.

7. Out-of-Court Dispute Settlement

  1. Users and reporting parties to whom the decisions referred to in section 3 are addressed have the right to select any certified out-of-court dispute settlement body in order to resolve disputes concerning those decisions and complaints that have not been resolved under the internal system referred to in section 5.

12. FINAL PROVISIONS

  1. The Administrator reserves the right to amend these Terms, in particular in the event of changes in the law, the development of the Service’s functionality, or organizational changes.
  2. Users holding an account will be informed of changes to the Terms through a notice in the Service or by e-mail, where technically possible.
  3. The amended Terms enter into force 14 days after their publication, unless applicable law requires a different deadline. The changes do not apply retroactively.
  4. In matters not regulated by these Terms, the provisions of Polish law apply.
  5. If any provision of the Terms proves to be invalid or ineffective, the remaining provisions retain their full binding force.
  6. The user may request the deletion of their account before the changes enter into force if they do not accept them.
  7. The Terms are effective as of the date of their publication in the Service.
